Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Scavio API and related services ("Service") operated by Scavio ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Definitions

  • "API" means the Scavio application programming interface, including all endpoints, documentation, and SDKs.
  • "API Key" means the unique authentication credential issued to you for accessing the API.
  • "Credit" means one unit of API usage. Each API request consumes one Credit.
  • "Customer Data" means queries, search parameters, and configuration data you submit through the API.

2. Account Registration

To use the Service, you must create an account and obtain an API Key. You agree to:

  • Provide accurate and complete registration information.
  • Keep your API Key confidential and not share it with unauthorized parties.
  • Notify us immediately if you suspect unauthorized use of your account.
  • Be responsible for all activity that occurs under your account.

3. Service Description

Scavio provides a real-time search API that returns structured JSON results from multiple platforms including Google, Amazon, YouTube, and Walmart. The Service is provided on a credit-based billing model where each API request costs one Credit regardless of the target platform.

4. Plans, Billing, and Credits

4.1 Subscription Plans

We offer multiple subscription plans with varying Credit allocations. Plan details, pricing, and Credit limits are listed on our pricing page. We reserve the right to modify pricing with 30 days' prior notice.

4.2 Billing

  • Paid plans are billed monthly in advance in US dollars.
  • All fees are non-refundable except as required by applicable law.
  • You are responsible for all applicable taxes.

4.3 Credits

  • Unused monthly Credits do not roll over to the next billing period.
  • Pay-as-you-go Credits are available at the rate published on our pricing page.
  • We may suspend your access if your account has insufficient Credits.

4.4 Free Tier

The free plan provides 1,000 Credits per month. The free tier is subject to standard rate limits and may be modified or discontinued with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Scrape, redistribute, or resell raw search results as a competing search API service.
  • Circumvent rate limits, authentication mechanisms, or other technical restrictions.
  • Send automated queries designed to overload or degrade the Service.
  • Use the Service for any activity that could cause harm to minors.
  • Transmit malware, viruses, or any destructive code through API requests.
  • Misrepresent your identity or the source of API requests.

6. Rate Limits and Availability

  • API requests are subject to rate limits that vary by plan. Rate limit details are available in our documentation.
  • We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.
  • We may throttle or temporarily suspend access to maintain service stability.

7. Intellectual Property

  • We retain all rights in the Service, API, documentation, and related technology.
  • You retain ownership of your Customer Data.
  • Search results returned by the API originate from third-party platforms. You are responsible for complying with those platforms' terms of service when using the data.
  • We grant you a limited, non-exclusive, revocable license to use the API in accordance with these Terms.

8. Data Handling

  • We process Customer Data solely to provide the Service.
  • We do not sell your Customer Data to third parties.
  • API request logs may be retained for up to 90 days for debugging and abuse prevention.

9. Termination

  • You may cancel your account at any time through your dashboard.
  • We may suspend or terminate your access if you violate these Terms, with notice when feasible.
  • Upon termination, your API Key will be revoked and unused Credits will be forfeited.
  • Sections 7, 10, 11, and 12 survive termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SEARCH RESULTS WILL BE ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

14. General

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Scavio.
